Initially, you'll need to register with the government (federal) for an EIN, or employer identification number, so that you can handle employment matters and other business matters.  If you move forward without registering with federal government, you may be subject to a variety of monetary and legal penalties.  You should also register with your state government, which will issue you a separate EIN.

State and local licensing (obtaining a permit) for your restaurant can be a somewhat more involved process, and each state and county has different rules.  You will therefore want to look through the formal documentation in your area guiding you through the restaurant licensing process, and you may want to seek the assistance of legal counsel.
